Terms and conditions of www.sk.e-demokratia.org

Terms and conditions governing use of the website are set in the following provisions of the Statutes of sk.e-demokratia:

  1. Registered user (Art. 7),
  2. Civility of the discussion (Art. 49),
  3. The consequences of failure to comply with these terms and conditions (Art. 50),
  4. Party’s intellectual property protection (Art. 58).

User registration in accordance with Art. 7 of Statutes

  1. To become a registered user can only person who has reached the age of 15 years and agrees with the conditions and terms of use of the website.
  2. User registration is free and is a condition for the right to place text on the website.
  3. When registering a user via the website will provide these registration data:
  1. Name,
  2. Surname,
  3. District of permanent residence,
  4. pseudonym (používateľské meno), ktorý musí byť zvolený tak, aby sa nezhodoval s pseudonymom iného používateľa (jedinečnosť pseudonymu zabezpečuje portál),
  5. pseudonym (username) that does not match the pseudonym of another user. The website ensures compliance with this condition,
  6. Electronic post address (e-mail address),
  7. Password.
  1. The user shall act within the website using the pseudonym, other user’s registration data shall not be published. The pseudonym of the user might be identical with their real name on condition that the user makes such a choice during the registration. The user might publish or modify a brief self-introduction whenever needed, but they shall be completely responsible for the content of such self-introduction and providing that this information contains their personal data, its publication shall be considered voluntary and intentional in accordance with the Act on the protection of the personal data.
  2. The website shall check the password quality and shall secure the protection of the transmitted personal information.
  3. Creation of a user account is subject to approval of the Chancellor who controls the suitability of the chosen pseudonym.
  4. The Chancellor shall not check the correctness of the registration data. The user shall be responsible for its correctness. With the exception of the pseudonym, the user can change their registration information. The user can revoke their user account at any time; their registration data and posts remain on the website even after the cancellation of registration and their pseudonym can no longer be used by another person.
  5. The user shall log in the website using their email address/pseudonym and password.
  6. The Chancellor is authorized to change the registration procedure for the user, if they consider that it is necessary to raise its technical standard or improve user identification.
  7. Registered user shall have beyond the visitor's rights the following additional rights:
  1. To suggest the establishment of factual forums throughout the Chancellor's forum – On factual forums,
  2. To contribute to the discussion and comment on the suggestions of the resolutions in the factual forums and in the factual forums of representatives,
  3. Appeal to the Arbitration committee if they consider that they application for membership was rejected by Chancellor illegally.

Civility of the discussion in accordance with Art. 49 of the Statutes

  1. The discussion posts must be factual using the literary, grammatically correct language with understandable expressions that shall undoubtedly be an attribute of civility.
  2. Posts contrary to the Civility Program shall be prohibited, i.e. the posts instigating violence, zealotry, racism, hatred against particular people or groups, mainly against ethnical and religious groups, personal attacks, threats or harassment as well as posts containing of obscenities or vulgarisms.
  3. It shall be prohibited to write discussion posts under somebody else’s name, to order of another person, act like the Office employee or any other (mainly publicly active) person who might feel aggrieved by such proceedings.
  4. It shall be prohibited to contribute to the discussion with the same content, by multiple links on a website outside of the website of sk.e-demokratia and to use graphic elements designed to attract undue attention of the reader (eg. writing texts with capital letters alone).
  5. It shall be prohibited to promote commercial products or companies in the discussions or publish the links to their web pages.
  6. It shall be prohibited to insert into the discussions text whose author is not the contributor themself (quotations), to the extent exceeding one typical paragraph.
  7. It shall be prohibited to insert into the discussions information about the identity of other users or members without their prior agreement, mainly their email address, address, telephone number etc.
  8. The party shall allow the performance of political activity via its website, but accepts no responsibility for the content added by the users and members nor for the member’s evaluation of other debaters.
  9. Information from the forums should be critically evaluated.
  10. It shall be prohibited to use the website to disseminate defamatory, libelous, obscene and other illegal material such as child pornography, certain information concerning illegal drugs, or homing information to enable infringement of copyright, etc.
  11. It shall be prohibited to publish links to web pages whose content is contrary to laws of the Slovak Republic, i.e. the web pages promoting racism, promoting illegal software etc.
  12. Users are required to ensure that no one acts under their identity on the website.
  13. The users should avoid providing the personal information in the discussions (smart card number, address, telephone number, password etc.).

The consequences of non-compliance with the terms and conditions in accordance with Art. 50, par. 10 to 15 of the Statutes

  1. If a member believes that the discussion post is uncivilized, which means that it is incompatible with the concept of the party, its program and Statutes, they should report this fact to the leader or Chancellor via a link located at each discussion post.
  2. Leader or Chancellor can remove uncivilized discussion posts from the mainline discussion and place them in quarantine.
  3. Discussion posts placed in quarantine shall not appear on the web page of the discussion, but they are accessible via respective hypertext link to all visitors, except discussion posts that violate the law. These shall be placed into the super quarantine where they shall be accessible only to the Chancellor and to the members of the Control commission and Arbitration commission.
  4. If a user places on the website discussion posts that repeatedly end up in quarantine, the Chancellor is authorized to revoke the registration of the user and delete all their discussion posts.
  5. If a member places on the website discussion posts that repeatedly end up in quarantine, the Chancellor or any member shall be entitled to refer the matter to the Arbitration committee, which will determine the way forward.
  6. If a discussion post violates the laws of the Slovak Republic, the Chancellor or the leader shall be entitled to delete it from the web website regardless of whether it was added by a member or by a registered user.

Copyright and conditions of insertion and usage of posts in accordance with Art. 58 of the Statutes

  1. The party documents and the party database shall be subject to the copyright law in accordance with Act No. 618/2003 Col. on the copyright law and the rights related to the copyright law, as amended.
  2. By adding the post on the web website which is subject to the protection of the intellectual property in accordance with generally binding prescriptions (hereinafter referred to as „post“), its author (hereinafter referred to as „the author of the post“) declares that they are not breaching the laws, rights of any third persons and that they grant their consent to use this post to the extent, in the way and under the following conditions to the website, to the party and its members and registered users:
    1. The consent shall be granted for an unlimited period and the author of the post shall not be entitled to withdraw their consent,
    2. The consent shall be free (not subject to any remuneration),
    3. The consent shall be transferrable; the right to use the post might be transferred to third persons and the party shall dispose of it by the Chancellor,
    4. The consent shall be granted unconditionally, however, the author shall be entitled exercise all the rights that had been granted in accordance with this article,
    5. The consent shall be granted worldwide,
    6. The post might be published on the website by other persons on condition that the name of the author or their pseudonym remains attached to it,
    7. The post might be quoted by another author on condition that the name of the author or their pseudonym remains attached to it,
    8. The post might be processed, modified or adapted into another party document without any additional consent of the author and in case of the document drawn up by the party body, neither the name nor the pseudonym of the author must be stated; such documents might be named and used as the party documents, i.e. the author´s post might become a part of the forum resolution, party program, leader´s or representative´s speech, media announcement etc.
  3. Any further distribution of the party documents, mainly the Statutes, resolutions and programs as well as the extraction of the party database or further use might be possible only based on the previous written consent of the Chancellor.
